1. HIPAA & Healthcare Data Compliance

As a healthcare-focused digital presence, we take the security of medical information seriously.

Any individually identifiable health information you explicitly transmit to us via patient intake forms, scheduling portals, or clinical contact vectors is handled in strict compliance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the Health Information Technology for Economic and Clinical Health (HITECH) Act.

Business Associates:

Where a vendor creates, receives, maintains, or transmits PHI on our behalf, we require a Business Associate Agreement (BAA) as HIPAA requires.

Website forms are not a secure medical channel:

Our contact and accessibility forms, the online chat assistant, and regular email are not designed for sensitive clinical details. Please do not include diagnoses, test results, or other health information in them. To discuss your care, call our office or use the secure scheduling and patient tools linked from this Site.

We collect both Non-Personal Information and Personal Information to provide our services:

Non-Personal Information:

Includes tracking data, browser types, device information, and anonymized usage statistics collected via cookies to enhance user experience.

Personal Information:

Includes details you voluntarily provide (e.g., your name, email address, phone number, and the message you write in our contact, accessibility-report, or appointment-request forms).

Automatically collected:

IP address, browser and device type, pages viewed, and approximate location derived from the IP address. We also use your IP address to limit abusive or automated form submissions.

Children:

This Site is not directed to children under 13, and we do not knowingly collect personal information from them through the Site.

Retention:

3A. Service Providers & Third-Party Tools

The Site uses the following third-party services. Each receives only the information needed for its function and handles it under its own privacy policy:

• Online scheduling (Healow / eClinicalWorks): When you choose “Book Appointment,” you leave this Site and enter a separate patient scheduling service run by our electronic health record vendor. Information you enter there is handled under that service’s terms and privacy policy and our agreements with the vendor.
• Google Tag Manager & analytics: Help us understand how the Site is used (pages viewed, device type, approximate location).
• Google reCAPTCHA: Protects our forms from spam and abuse. It analyzes browser and interaction signals and is subject to the Google Privacy Policy and Terms of Service.
• Chat assistant (LeadConnector): A website chat widget. Messages you type there are processed by the provider. Do not enter medical details in the chat.
• Email delivery and hosting providers: Used to deliver form notifications to our staff and to host the Site.
• Google Maps and reviews: Links to our Google Business Profile open on Google’s site.

4. SMS Messaging & Mobile Privacy (10DLC Carrier Compliance)

If you elect to receive SMS text messages from Motionis Medicine (such as appointment reminders, clinical updates, or customer support notifications), your phone number and consent details will be handled with strict confidentiality.

No Third-Party Sharing:

Mobile information and SMS opt-in consent data will not be shared, sold, rented, leased, or traded with third parties or affiliates for their own marketing or promotional purposes.

Data Exclusion:

The provisions of this section override any other data-sharing permissions listed elsewhere in this Privacy Policy; your SMS consent data is strictly excluded from all third-party sharing mechanisms.

5. Data Security Safeguards

We maintain administrative, technical, and physical safeguards designed to prevent unauthorized access, disclosure, or modification of your data:

• Pages and forms on this Site are served over an encrypted connection (HTTPS/TLS).
• Access to administrative tools is limited to authorized staff and protected by individual credentials.
• Email and text messages are generally not encrypted end to end. Please keep sensitive health details out of them.

Depending on your jurisdiction, you have specific rights regarding your Personal Information and medical records, including:

Medical information we hold as a HIPAA-covered provider is governed by HIPAA and New York law. Some of these rights do not apply to information covered by HIPAA.

We do not sell personal information. We do not discriminate against anyone for exercising these rights. To make a request, email privacy@motionis.health or call our office; we will verify your identity and respond within 45 days. You may also use an authorized agent.

We use session cookies that are necessary for the Site to work (for example to protect forms) and, through Google Tag Manager and analytics, cookies that help us understand how the Site is used. The Site does not respond to other “Do Not Track” signals. Cookies that are strictly necessary for the Site to work (such as the form-protection session) cannot be turned off.
